Yes, it's genuine, and no, it's not legal unless you have an MSDN or TechNet subscription or a Beta agreement: it's the February CTP version. The public Beta won't be available for another couple of months, give or take a few weeks. Do you have a product key?
If you don't, then don't download it. And if you get a product key from someone other than MS, then its called piracy and they can trace that back to the person who was given that key.

No, I don´t have a product key, so thank you for your warning, I will not download it.That´s the reason why I asked. I thought this is the public beta already.
and by the way: if I would be interested in a pirated beta, the last download source I´d use would be Microsoft :-).

I think you are mistaken as to what a staged build is. Staged builds are basically system images that are pre-created on a fairly basic machine back at Redmond. The basic idea is that this system image can be copied over and tailored to the exact needs of the system it's being installed on a lot faster than the traditional method of copying file by files/setting by setting.
5342 is a staged build and it installed a *lot* faster (under an hour) than the unstaged 5308 build (closer to 3 hours) did on my laptop, and that is far from being a power PC - Intel Celeron 1.4, 768MB Ram, 40GB hd.

Well, unless you're sleeping with one of the beta team - it's very unlikely now. Best off waiting for the public beta to rollout, expected later this month but more than likely early May.

They aren't making it into a public preview, and it's not at Beta 2 stage yet so it would be inappropriate for them to release it as a public release.

And, If you don't like my Spam (I prefer to call it Complaint's to Microsoft, However), you can Opt-Out by Blocking me as a Sender in either Outlook Express 6.0 or Windows Mail 7.0.
P.S. Here in the United States we have a Spam Opt-Out Policy (The Can-Spam Act of 2004, which is a complete joke of a law), and not the other way around like you guys have in the European Union, so I have no fears whatsoever.
P.P.S. I intend to continue to Complain to Microsoft until they give me Build 5342, or this month's release (when it is released, that is).

I personally don't have anything against you, but posting so many separate post is just gonna get ignored by MS folks if you really want to get their attention. You are great part of these groups and I do like your strong focus on getting things right in Vista, but at the same time, you need to take a more civilized approach at accomplishing this.
